This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit [ivylistre.com] (the “Site”), use our services, or interact with us. It also explains your privacy rights under the Texas Data Privacy and Security Act (TDPSA) and other applicable U.S. laws.

2) Scope

This Policy applies to personal information we collect:

  • On the Site, through lead/contact forms, home valuation tools, and newsletter/SMS sign-ups

  • During showings, open houses, or events

  • Via phone, email, chat, or social media

  • From third-party sources (e.g., advertising platforms, referral partners, public records, and Multiple Listing Service (MLS/IDX) providers)

It does not apply to information processed by third parties we do not control. Their privacy policies govern their handling of your data.


3) What We Collect

We collect the following categories of personal information (examples in parentheses):

  • Identifiers & Contact Info (name, email, phone, postal address)

  • Real-estate Interest Data (areas, price range, property preferences; showing feedback)

  • Transaction-Adjacent Data (pre-approval status, lender/referral interests you share with us)

  • Online Activity/Device Data (IP address, pages viewed, form interactions, cookies, analytics, approximate geolocation)

  • Marketing Preferences (email/SMS consent, opt-out choices)

  • User-generated Content (messages or files you submit)

We do not knowingly collect data from children under 13. If we learn a child under 13 has provided personal information, we’ll delete it.


4) How We Use Personal Information

We use personal information to:

  • Respond to inquiries; schedule showings and tours; provide property alerts and market updates

  • Perform real-estate services (CMA/home valuation, listing promotion, buyer/seller representation)

  • Send marketing communications (email and, with proper consent, SMS—see Section 8)

  • Improve the Site, analytics, and ad measurement/retargeting

  • Detect, prevent, and respond to security, fraud, or abuse

  • Comply with legal obligations and Texas real-estate rules (including required TREC notices)


5) Cookies, Tracking & Analytics

We use cookies and similar tech to operate the Site, understand usage, and measure campaigns. You can manage cookies in your browser. Some features may not function without certain cookies.

  • Targeted Ads/Analytics. We may use analytics (e.g., Google Analytics) and advertising partners to measure performance and show relevant ads. You can opt out of targeted advertising as described in Section 10 (TDPSA rights).

Beginning January 1, 2025, Texas law activates additional opt-out mechanisms (e.g., authorized agent opt-outs). We will honor these as required by the TDPSA.


6) How We Share Information

We may share personal information with:

  • Service Providers/Processors (hosting, CRM/lead management, email/SMS delivery, analytics, payment processors, cloud storage)

  • Real-Estate Partners (co-listing agents, showing services, home inspectors, stagers, photographers)

  • Advertising & Measurement Partners (to run or measure campaigns; you can opt out—see Section 10)

  • Lenders/Title/Insurance only at your request or with your consent

  • Legal/Compliance recipients (to comply with law, protect rights, or respond to lawful requests)

  • Business Transfers in the event of a merger, acquisition, or asset sale

We do not sell personal information in exchange for money. If our use of ad tech is deemed a “sale” or “targeted advertising” under TDPSA, you have the right to opt out (Section 10). Texas Attorney General


7) Data Security & Retention

We implement reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. No security method is perfect. We retain information only as long as needed for the purposes described, to meet legal/recordkeeping duties, or to resolve disputes.


8) Email & SMS (TCPA/CAN-SPAM)

  • Email: You can unsubscribe at any time via the link in our emails.

  • SMS: We only send marketing texts with prior express written consent. Consent isn’t a condition of purchase. Message/data rates may apply. Message frequency varies. Text STOP to opt out, HELP for help. We honor Do-Not-Call requests and applicable TCPA rules.


9) Your Texas Privacy Rights (TDPSA)

If the TDPSA applies to our processing activities, Texas residents may exercise these rights, subject to exceptions:

  • Access – confirm whether we process your personal data and access it

  • Correction – correct inaccuracies in your personal data

  • Deletion – delete personal data you provided or that we obtained about you

  • Portability – obtain a copy of your personal data in a portable format

  • Opt Out – of the processing of personal data for targeted advertising, any sale of personal data, or profiling that produces legal or similarly significant effects

We will respond within the timelines required by law and provide an appeal process if we decline your request. Starting January 1, 2025, TDPSA expands mechanisms for using an authorized agent to exercise opt-out rights; we will honor those as required.


10) How to Exercise Your Rights

To opt out of targeted advertising or similar sharing, use our Site’s “Do Not Sell or Share / Ad Preferences” link or submit a request via the methods above. Beginning January 1, 2025, we will recognize additional TDPSA-required opt-out mechanisms, as applicable.


11) Third-Party Links & IDX/MLS Content

Our Site may link to third-party websites, tools, or embedded MLS/IDX listing content. Their practices are governed by their own policies. Review those before providing personal information.

13) Changes to This Policy

We may update this Policy to reflect changes in our practices or the law. We’ll post the updated version with a new “Last Updated” date. If changes materially affect your rights, we’ll provide additional notice as required.


14) Additional U.S. Law Notes

  • Children’s Privacy (COPPA): Our services are not directed to children under 13; we do not knowingly collect their data.

  • CAN-SPAM: Marketing emails include our address and an easy unsubscribe.

  • TCPA: Marketing calls/texts require the appropriate level of consent (e.g., prior express written consent for autodialed/promotional texts).
